Gary M. Remer is a shareholder with the firm Hertz Schram PC. Gary is a highly experienced employee benefits, franchise, and business lawyer. He advises business owners, including franchisors and franchisees, on business entity formation and maintenance, commercial contracts, finance, regulatory compliance and retirement plans. Gary began his career as a Revenue Agent with the United State Internal Revenue Service, Employee Plans Division, where he honed his expertise with employee welfare and benefit plans. He is a former adjunct professor at Walsh College where he taught post-graduate tax classes on pension and profit sharing plans, ESOPs, nonqualified deferred compensation plans, health care plans, insurance plans, and other fringe benefits.
Gary designs retirement plans that provide significant benefit accruals for business owners. Clients often ask him to correct retirement plan operational and document deficiencies such as the exclusion of eligible participants, loan failures, untimely 401(k) deposits, and late amendments to retirement plan documents. In order to protect assets from becoming immediately taxable and reduce fiduciary liability, he submits the retirement plans to the Internal Revenue Service and/or Department of Labor for rulings. Gary helps clients develop succession plans for their businesses which may involve terminating employee stock ownership plans and the distribution of ownership to the employees.
